Miami Criminal Lawyer Discusses changes to court proceedings in light of Coronavirus

The sweeping pandemic, caused by the novel Coronavirus aptly named COVID-19 has, in some way, impacted virtually all aspects of business and daily living. As of April 1st, 2020, 37 states across America have issued some form of “stay at home” orders, limiting business to those deemed “essential”.

Although Florida was slow to adopt such measures, ballooning cases in the Sunshine State (especially in dense neighborhoods such as those in and around Miami) prompted Governor Ron DeSantis to issue a statewide order to “stay at home”.

With business and life as Floridians know it all but grinding to a halt, many area residents have questions regarding the court systems and other legal considerations. Chad Piotrowski of Piotrowski Law in Miami is here to clear the air and make sure Floridians are supported during this trying time with aggressive and compassionate criminal defense representation that gets results.

Miami-Dade Court Proceedings Now Being Remotely Held

Miami-Dade County courts are now operating in a limited capacity with one operational courtroom where representation can appear by phone. The courts plan on utilizing teleconferencing soon and current orders extend these changes through May 30th.

According to Piotrowski, this poses unique challenges for clients and attorneys alike, stressing the importance of working with a dynamic law firm adept at effectively utilizing and communicating through these evolving solutions.

Among the First Law Firms to Digitize Consultations

Piotrowski Law Firm ranks among the first law firms in South Florida to quickly adapt to remote proceedings and hearings. As a firm that places value on forward-thinking and agility, they were fast to adapt and transition to providing high-quality, aggressive and effective legal representation through video and audio. Those needing criminal defense representation or facing other legal challenges shouldn’t postpone getting help. Early intervention can often improve a client’s chances of obtaining a positive outcome.

Law Enforcement and Corrections Agencies are Adapting Too

Non-essential businesses may be closed, but law enforcement and corrections agencies are still out in full force, employing unique measures to carry out “business as usual”.

For example, according to Piotrowski, some people charged with criminal offenses may be let out of jail or let free (temporarily) even without bail in order to prevent the spread of infection throughout the Florida correctional system. However, not all are so fortunate. Those with loved ones being currently detained should seek out assistance from Piatkowski Law firm in order to file the necessary motions for release.

Further, some crimes are now subject to “enhanced” criminal penalties due to the state-issued emergency order. Those facing enhanced criminal charges as a result of the “state of emergency” declaration are encouraged to reach out for legal support and counsel as soon as possible.

Pending Charges May Be Pursued Later

Some jurisdictions across South Florida are limiting arrests in order to minimize law enforcement contact with the public and are even releasing non-violent offenders such as those facing non-violent and lower-level drug charges. The Miami-Dade State Attorney’s Office is making determinations on a “case by case” basis.

However, according to Piotrowski, offenders aren’t necessarily “off the hook”. The state can and may pursue any charges pending at a later date even if released.
